Terms of Service

In effect from 25 July 2026

Draft — not yet in force. This document is missing the operator’s registered details (legalName, address, registrationNumber, jurisdiction, supervisoryAuthority). Fill them in apps/web/app/(legal)/legal-config.ts and have the text reviewed by a qualified lawyer for your jurisdiction before relying on it or accepting payments.

These terms are the agreement between you and TODO — registered legal name ( “we”, “us”) for your use of audiotoggle. By creating an account or using the service you accept them. If you do not, please do not use the service.

1. What the service does

audiotoggle plays two audio files in sync and lets you switch between them instantly, so differences are easy to hear. You can use the tool at /compare without an account and without uploading anything. With an account you can save comparisons, upload both files and share them by link. Pro adds level matching, player customization, embedding, analytics, branding and higher limits.

2. Your account

  • You must be at least 16 years old.
  • Give accurate details and verify your email address.
  • Keep your password to yourself. You are responsible for what happens under your account; tell us promptly if you think it has been compromised.
  • One person or organisation per account. Do not resell access to your account.

3. Your content stays yours

You keep all rights to the audio, artwork and text you upload. We claim no ownership of it.

You grant us a limited, non-exclusive licence to store, copy, transmit and play your content purely so that we can operate the service for you — that is, to stream it back to you and to anyone you deliberately share a link with. That licence ends when you delete the content or your account. We do not use your audio for advertising, for promotion, or to train machine-learning models.

You confirm you have the rights to everything you upload. Do not upload material you do not have permission to use.

4. Sharing and publishing

Publishing a comparison creates a long, unguessable URL. It is not password-protected: anyone with the link can listen, and links may be visible to search engines if you share them publicly. Do not publish material that must stay confidential. You can unpublish at any time, though caches may take up to about 45 minutes to clear.

5. Acceptable use

Do not:

  • upload or share anything unlawful, infringing, or that you lack the rights to;
  • use the service to distribute malware or to harass anyone;
  • attempt to break, overload, probe or circumvent the service, its rate limits, its plan limits, or its access controls;
  • scrape, resell or redistribute the service or other users’ content;
  • use it as general-purpose file hosting or a CDN for unrelated media.

We may suspend or terminate accounts that breach this section, and remove content we are legally required to remove.

6. Plans and limits

The Free plan includes 3 saved comparisons, 500 MB of storage and files up to 50 MB. Pro includes 50 comparisons, 25 GB of storage and files up to 500 MB. Lossless playback is included on every plan. Current details are always on the pricing page.

7. Subscriptions, billing and cancellation

  • Pro is billed in advance, monthly or yearly, through Stripe. Prices are shown on the pricing page and include or exclude tax as indicated at checkout.
  • Subscriptions renew automatically at the end of each period until you cancel.
  • You can cancel at any time from your account settings. Cancelling stops future charges; your Pro features stay active until the end of the period you have already paid for.
  • If a payment fails we keep Pro active for a short grace period while Stripe retries. If it keeps failing, the account moves to Free.
  • Downgrading never deletes your data. Content over the Free limits stays stored but Pro-only features (custom labels, level matching, customization, embedding, analytics, branding) stop applying until you resubscribe, at which point your settings come back as they were.
  • We may change prices with at least 30 days’ notice by email. The new price applies from your next renewal, and you can cancel before then.

Refunds

If you are a consumer in the EU/UK you have a statutory 14-day right to withdraw from a digital-services purchase. Because Pro features are available immediately, that right may be reduced once you start using them — but in practice, if you are unhappy within 14 days of a charge, email us and we will refund it. Beyond that, payments for periods already served are non-refundable except where the law requires otherwise.

8. Availability

We work to keep audiotoggle available and your files intact, but we do not promise uninterrupted service. We may take it down for maintenance, and we may change or remove features. Parts of the service are still in beta and are clearly marked as such.

Keep your own copies of your audio. audiotoggle is a comparison and sharing tool, not a backup service.

9. Liability

The service is provided as-is, without warranties beyond those the law requires. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost opportunities, or loss of data you had no other copy of. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the 12 months before the claim, or EUR 50.

Nothing here limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited.

10. Ending the agreement

You can stop using the service and delete your account whenever you like, from your account settings. Deletion is permanent and removes your projects, uploaded files and analytics.

We may suspend or close an account that breaches these terms, that we are legally required to close, or that has been inactive on the Free plan for a very long time — in which case we will give reasonable notice by email where we can.

11. Changes to these terms

We may update these terms. For material changes we will notify registered users by email and update the date at the top before they take effect. Continuing to use the service after that means you accept the new terms.

12. Governing law

These terms are governed by the law of TODO — governing law / jurisdiction, and disputes go to the courts there. If you are a consumer, this does not remove any protection you have under the law of your own country of residence.
